1. GENERAL TERMS
1.1. The terms and conditions apply to legal relationships between all persons and the owner of the e-shop dslkaubad.ee (owner DSL Kaubad OÜ, registration number 16703933) hereinafter DSL Kaubad when purchasing products through the DSL Kaubad e-shop.
1.2. DSL Kaubad has the right to unilaterally change and supplement the terms and conditions by publishing the new terms and conditions at www.dslkaubad.ee . If the customer placed an order before the changes to the terms and conditions came into force, the legal relationship between the customer and DSL Kaubad will be subject to the terms and conditions valid at the time the order was placed, unless otherwise provided by law or these terms and conditions.
1.3. Before making a purchase, the customer can save, print and, if necessary, reproduce the terms and conditions, and the customer agrees to the terms and conditions when making a purchase from the e-shop.
1.4. In addition to the terms and conditions, the legal acts in force in the Republic of Estonia apply to making a purchase from the e-shop.
2. ORDER SUBMISSION
2.1. The customer selects the desired goods from the e-shop and adds them to the shopping cart.
2.2. The customer chooses the method and place of delivery of the order.
2.3. The customer confirms the shopping cart and pays for the goods in the payment environments provided by DSL Kaubad. Before paying the invoice, the customer checks that the information given in the invoice corresponds to the customer’s actual wishes.
2.4. After paying for the goods, the customer must click on the “Back to the merchant” link.
2.5. DSL Kaubad sends a confirmation to the customer by e-mail about the receipt of the order and payment. If you do not receive a confirmation e-mail, please contact customer support at [email protected] or call +372 53736308 Mon-Fri 8:00 – 17:00.
2.6. The invoice is sent with the goods.
2.7. The contract for the sale of the products is deemed to have been concluded (the entry into force of the Contract) upon receipt of the amount to be paid according to the order confirmation to the current account of DSL Kaubad.
3. PRICE OF GOODS, PAYMENT OPTIONS
3.1. All prices of goods sold in the e-shop are in euros and include 20% VAT.
3.2. The customer pays the sales price of the goods and the delivery fee in full in advance for the order. Payment is made outside the e-shop in the corresponding payment environment. DSL Kaubad does not have access to the customer’s bank and credit card data.
3.3. In the event that the Customer does not choose to pick up the ordered goods at DSL Kaubad himself, the delivery fee will be added to the sales price in accordance with the delivery conditions.
3.4. In order to make the payment, the customer must choose the preferred payment method on the order form page:
3.4.1. through internet banking. (via Swedbank, AS SEB Pank and Danske Bank A/S Estonia branch bank links)
3.4.3. by credit card (Visa or MasterCard) or through Paypal.
3.4.4. on the basis of an advance invoice. The goods on the order will be booked no later than the next working day after the amount indicated on the advance invoice is received.
3.4.5. a service fee may be added to the cost of the order in accordance with the contract concluded between the customer and the bank or credit card issuer.
4. RECEIPT OF GOODS
4.1 The goods can be ordered to the DSL Kaubad address, the parcel machine of the selected service provider or to the address indicated by the customer using the courier service.
4.2. Online store orders are handled on weekdays from 8:00 – 17:00. Orders placed on Saturdays, Sundays and public holidays will be processed on the following working day. Also applies to the “Pick me up at the tool center” delivery method.
4.3 Receiving the goods from DSL Kaubad.
4.3.1. Goods are issued during the opening hours of DSL Kaubad.
4.3.2. The goods are issued to the customer upon presentation of an identity document (ID card, passport, driver’s license) and order number. In the absence of an identity document, DSL Kaubad may refuse to issue the goods.
4.3.3. DSL Kaubad is not responsible for damage caused to the customer if, for reasons not attributable to DSL Kaubad , third parties have obtained a copy of the invoice or a unique order number and the goods have been received on the basis of this.
4.3.4. When ordering to pick up the goods at the DSL Kaubad address, the delivery fee is not added to the amount.
4.3.5. If the customer does not pick up the goods within 14 calendar days, DSL Kaubad will consider that the customer has canceled the order and DSL Kaubad will return the purchase amount to the customer immediately, but no later than within 14 calendar days, to the same current account from which the purchase was paid.
4.4. Picking up the goods from the parcel machine
4.4.1. When the goods are delivered to the parcel machine chosen by the customer, a delivery fee is added to the price of the goods. If the cost of the order exceeds 150 euros, the delivery fee is not added.
4.4.2. The customer will be notified of the delivery of the goods to the parcel machine with an SMS message to the number entered by the customer at the time of purchase. The SMS contains a unique door code to open the door of the parcel machine.
4.4.3. DSL Kaubad is not responsible for damage caused to the customer if, for reasons not attributable to DSL Kaubad, third parties have obtained the parcel machine’s unique code and the goods have been received on the basis of this code.
4.4.4. If the customer has not received the goods from the parcel machine after the storage period has passed, DSL Kaubad considers that the customer has canceled the order and DSL Kaubad will return the purchase amount to the customer along with the delivery fee immediately, but no later than within 14 calendar days, to the same current account from which the purchase was paid.
4.5. Receiving the goods by courier
4.5.1. When choosing a courier to deliver the goods, the delivery fee is added to the price of the goods. Prices include VAT.
Shipment under 30 kg and order over 150 EUR free, order under 150 EUR to parcel machine 2.90 EUR / courier 5.90 EUR
Shipment 30 kg to 60 kg, by courier 7.90 EUR
Shipment over 60 kg, by courier 9.90 EUR
4.5.2. Goods purchased from Monday to Thursday and delivered by courier will be delivered by courier to the address specified by the customer on the day following the purchase between 10:00 and 21:00. The goods purchased from Friday to Sunday will be delivered by courier to the address specified by the customer on the next working day between 10:00 and 21:00 at the latest. The courier agrees on the exact time of delivery of the goods with the customer in advance by phone.
4.5.3. The customer must ensure that the goods are received at the agreed time and address. If the delivery of the goods fails for reasons beyond the courier’s control on two consecutive occasions, the goods will be returned to the courier company’s terminal. In this case, the buyer can contact the courier within 14 days and ask to send the goods again via courier service to the delivery address indicated by the buyer. If the aforementioned attempts to deliver the goods to the customer fail, DSL Kaubad considers that the customer has canceled the order, the provisions of this agreement apply to receiving the goods from DSL Kaubad, and returns the purchase amount to the customer along with the delivery fee immediately, but no later than within 14 calendar days from the receipt of the goods to the same current account from which the purchase was paid .
4.5.4 Inspection of goods
4.5.5. Upon receiving the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and products. If the customer has damaged the packaging due to negligence, i.e. it was possible to open the product packaging without damaging it, DSL Kaubad has the right to demand compensation for the damage caused when returning the goods. In the event that the product packaging cannot be opened without damage/rupture, the customer is not responsible for the damaged packaging.
4.5.6. In the event that the customer discovers upon receiving the goods that the wrong or defective goods have been sent to him or that the goods do not reach the customer in good condition and in a closed package, he must immediately inform DSL Kaubad customer service +372 53736308 or [email protected].
4.5.7. DSL Kaubad is responsible for the goods purchased by the customer during their transportation. From the moment the goods are received, the risk of damage or loss of the goods passes to the customer.
5. PROCESSING OF THE CUSTOMER’S PERSONAL DATA
5.1. DSL Kaubad uses the personal data provided by the customer and data on the purchases made in accordance with the Personal Data Protection Act, which is necessary to fulfill the order placed by the customer in the e-shop. DSL Kaubad does not forward the customer’s personal data to third parties, except to companies offering postal or courier services to the extent necessary to deliver the goods to the customer.
5.2. DSL Kaubad does not have access to the customer’s bank details when paying for goods through the internet bank.
5.3. DSL Kaubad reserves the right to send information about its products and offers to the customer’s e-mail address and mobile number if the customer agrees. The customer has the right to request the deletion of his data from the DSL Kaubad database, for which a request must be submitted to the email address [email protected].
6. RETURNS, WITHDRAWALS AND REFUNDS
6.1. The customer has the right to withdraw from the contract without giving a reason within 14 calendar days from the receipt of the goods (from the time the goods are taken out of the parcel machine, except in the event of product defects, see point 7).
6.2. In order to return the goods, the customer must fill out a product return application and forward it together with the goods to the DSL Kaubad address or to the email address [email protected] before the goods are returned using the courier service.

6.3. When using the right of withdrawal, the customer is obliged to return the goods to DSL Kaubad no later than 14 days after submitting the withdrawal request.
6.4. If the purchased product is not suitable for any reason, you have the right to return the product to the DSL Kaubad tool center or by courier within 14 days of receiving the product. We advise the customer to ship all items they wish to return or ship in one go. Direct and indirect costs related to the return are borne by the customer. The goods to be returned must be unused and in the original packaging.
6.5. In the event that the customer has withdrawn from the transaction, DSL Kaubad will return the purchase amount to the customer along with the delivery fee immediately, but no later than within 14 calendar days from the receipt of the withdrawal statement to DSL Kaubad . The refund is made to the same current account from which the purchase was paid.
6.6. In the event that the customer has damaged or damaged the returned goods intentionally or due to negligence, the customer is responsible for the decrease in the value of the product and DSL Kaubad has the right to demand compensation for the damage caused. When the goods arrive at the parcel machine, the recipient must follow the goods in the parcel machine within the time set by the carrier or, if there is no such time, within 7 days, otherwise an additional transport fee will be added when resending.
7. SUBMISSION OF CLAIMS AND LIABILITY
7.1. DSL Kaubad is responsible for non-compliance and defects of products in accordance with the Law of Obligations Act, the time for submitting claims is 2 years for private individuals and 6 months for legal entities from the moment of delivery of the products. The buyer has the right to contact the e-shop within two months at the latest if a defect appears. If the goods purchased from the e-shop have defects for which the e-shop is responsible, the e-shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the e-shop will return to the buyer all fees associated with the sales contract. DSL Kaubad responds to the consumer’s complaint in writing or in a form that enables written reproduction within 15 days.
7.2. The customer must submit a claim by e-mail to [email protected] or at the customer service counter of DSL Kaubad place of business. In the claim, the name and contact details of the customer, the date of submission of the claim, the defect in the goods and the content of the claim must be stated, and a document proving the purchase must be attached.
7.3. DSL Kaubad is not responsible for damages caused to the customer or for delays in product delivery if the damage or delay in product delivery is due to a circumstance that DSL Kaubad could not influence and the arrival of which DSL Kaubad did not and could not foresee (force majeure).
7.4. DSL Kaubad is not responsible for damages caused by the non-intended use of the ordered goods, including if the delay results from incorrect data provided by the customer.
7.5. Disputes arising between DSL Kaubad and the customer are settled by negotiation. If no agreement is reached, the parties have the right to appeal to the Consumer Protection and Technical Supervision Board or the Harju County Court. The jurisdiction agreement is concluded, among other things, if the buyer settles in a foreign country after the conclusion of the agreement, or if he moves his place of business or location there, or if his place of business, residence or location is not known at the time of filing the lawsuit.

8 MAINTENANCE AND REPAIR PERFORMED BY DSL KAUBAD
8.1 DSL Kaubad will correct errors and defects in the Customer’s item during the repair and indicated by the Customer. Errors and defects are recorded in a written confirmation of the maintenance order.
8.2 Maintenance is defined as regular preventive work that is carried out to ensure the long-term use of the device in accordance with the user manual or maintenance book provided by the manufacturer.
8.3 The rebuilding of equipment and the replacement of equipment are not considered maintenance.
8.4 DSL Kaubad may charge a fee for preparing a repair estimate. The repair budget is not binding on DSL Kaubad, but he must not deviate significantly from it.
8.5 If it is not possible to determine the final deadline for handing over the work when submitting the item for repair or maintenance, then the deadline for determining the error or deficiency in the item will be determined. The deadline for handing over the work will be notified to the Client at the deadline for determining the error or deficiency.
8.6 When performing maintenance or repair work, DSL Kaubad uses its own materials.
8.7 Other errors and defects discovered during maintenance or repair performed by DSL Kaubad will be eliminated after reaching an agreement with the Customer.
8.8 DSL Kaubad undertakes to make an entry in the maintenance book about the work performed during the maintenance, if the Customer has submitted the maintenance book to DSL Kaubad.
9. WARRANTY OF SALE
9.1. The sales guarantee provider provides a sales guarantee for the goods in accordance with these conditions. A consumer within the meaning of these terms and conditions is a natural person if the purchase of goods is not related to his independent economic or professional activity.
9.3. If the product shows a material, construction or manufacturing defect during the sales guarantee period, the seller of the sales guarantee will repair the product free of charge.
9.4. If the repair of the goods is not successful or is not economically feasible in the opinion of the seller of the sales guarantee, the seller of the sales guarantee will replace the goods free of charge.
9.5. If the repair of the Goods is not successful or, in the opinion of the guarantor, it is not economically feasible, but replacement of the goods is impossible (especially if the same goods are no longer produced), the guarantor will return the money paid for the Goods.
10. The sales guarantee is not valid if:
10.1. The serial number of the item is not identifiable;
10.2. The defect of the goods is due to misuse;
10.3. A defect in the item is due to natural wear and tear;
10.4. The defect in the goods is due to an unusual external environmental effect (excessive humidity, heat, etc.);
10.5. The defect in the goods is due to an accident (e.g. a fall);
10.6. The product’s fault is due to failure to follow the instructions given in the product’s user manual or other document accompanying the product;
10.7. Periodic maintenance and
The customer has not turned to the representative office of the sales guarantee provider in order to perform this within the deadline.
11. The sales guarantee ends:
11.1. When the sales guarantee expires;
11.2. In case of removing or tampering with the serial number of the goods;
11.3. When the goods are repaired or attempted to be repaired by a person other than the person giving the sales guarantee.
11.4. If material appears on the product within the sales guarantee period,
Construction or assembly error, the Customer has the right to contact one of the following representative offices of the sales guarantee provider www.dslkaubad.ee during the warranty period.
11.5. When contacting the representative office of the sales guarantee provider, the Customer must hand over the goods for repair and describe the error that occurred. At the request of the representative office of the sales guarantee, the Customer must provide a document proving the time of purchase of the goods (e.g. invoice or these terms and conditions).
11.6 The seller of the sales guarantee will repair the goods free of charge within a reasonable period of time, which is not longer than 30 days. The seller of the sales guarantee informs the Customer that the goods have been repaired by phone or e-mail. After the repair, the Customer receives the goods from the same representative office where he handed it over for repair.
11.7 If the repair of the Goods is not successful or is not economically feasible in the opinion of the sales guarantee provider, the sales guarantee provider will inform the Customer of this by phone or e-mail, also informing the day when the Customer can receive it earlier
replaced goods. The customer receives the replaced item from the same office where he handed over the original item for repair.
11.8. If the repair of the goods is not successful or, in the opinion of the seller of the sales guarantee, it is not economically feasible, but the replacement of the goods
is impossible and the seller of the sales guarantee has decided to return the money paid for the goods, then the seller of the sales guarantee informs the Customer about this by phone or e-mail. In such a case, the customer is obliged to inform his/her current account number, where the seller of the sales guarantee can return the money paid for the goods. The seller of the sales guarantee will return the money within 14 days of receiving the current account number from the Customer. Money can be returned to a third-party current account only on the basis of a written application from the Client.
11.9. The seller of the sales guarantee does not compensate the Customer for the transportation costs of the goods or the damage incurred by the Customer in connection with the impossibility of using the goods during the time of its failure and repair. Under no circumstances will the seller of the sales guarantee compensate the Customer for lost income.
11.10. The term of the sales guarantee is extended by the period when the goods were under repair. The mentioned time period starts on the day the customer hands over the goods for repair and ends on the day when the seller of the sales guarantee informs the customer that the goods have been repaired.
11.11 If the seller of the sales guarantee replaces the goods free of charge, the period of the sales guarantee does not start again for the replaced goods. In this case, the original sales guarantee is extended by the period when the original product was under repair. The mentioned time period starts with the Customer
from the day of handing over the original goods for repair and ends on the day when the seller of the sales guarantee informs the Customer that the replaced goods can be received.
11.12 In addition to the rights arising from the sales guarantee, the consumer Customer also has other rights arising from the law.
